Terms of Service

Please read these Terms of Service ("Terms") carefully before using the GoBower platform at https://gobower.com (the "Service"), operated by GoBower ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of the Terms, you may not access the Service.

1. Acceptance of Terms

By creating an account or using the Service in any way, you confirm that you are at least 13 years old (or 16 in the EU/EEA), capable of entering into a binding agreement, and agree to these Terms and our Privacy Policy.

2. Description of Service

GoBower provides an AI-powered design platform for print-on-demand merchants. The Service allows users to generate, edit, and export graphic designs for use on physical products such as apparel, mugs, posters, and accessories. Features vary by subscription plan.

3. Accounts

3.1 Registration

You must register for an account to access most features. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your login credentials.

3.2 Account Security

You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your credentials.

3.3 One Account per Person

Each person may maintain only one free account. Creating multiple free accounts to circumvent plan limits constitutes abuse and may result in termination of all associated accounts.

4. Subscription Plans and Billing

4.1 Plans

We offer Free, Starter, Pro, and Business subscription plans. Features and usage limits for each plan are described on our Pricing page and may change with reasonable notice.

4.2 Billing

Paid subscriptions are billed monthly or annually in advance. By providing payment information, you authorize us to charge you via LemonSqueezy, our merchant of record. All fees are in US Dollars and non-refundable except as described in Section 4.4.

4.3 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You can cancel at any time from Settings → Billing.

4.4 Refunds

We offer a 7-day money-back guarantee on your first subscription purchase. To request a refund, contact [email protected] within 7 days of the charge. Refunds are issued to the original payment method within 5–10 business days.

4.5 Price Changes

We may change subscription prices with at least 30 days' notice. Continued use after the price change takes effect constitutes acceptance of the new price.

5. Intellectual Property and Licenses

5.1 Your Content

You retain all intellectual property rights in original content you create using the Service ("Your Content"), including prompts you write and images you upload. By using the Service, you grant us a limited, non-exclusive, royalty-free license to host, store, process, and display Your Content solely to provide the Service.

5.2 AI-Generated Designs

Designs generated by our AI based on your prompts ("Generated Designs") are made available to you under a commercial license. You may use Generated Designs to create and sell print-on-demand products without restriction. We do not claim ownership of Generated Designs.

You acknowledge that AI models may produce similar outputs for different users. We do not warrant that Generated Designs are unique or free from third-party intellectual property claims.

5.3 Our Intellectual Property

The Service, including its software, UI, branding, trademarks, and all content we create, is owned byGoBower and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without written permission.

5.4 Feedback

If you submit suggestions or feedback, you grant us the right to use it without compensation or attribution.

5.5 Third-Party Marketplace Integrations

The Service allows you to connect third-party marketplace accounts (e.g., Etsy) to publish and manage product listings. When you use these integrations:

  • You are solely responsible for complying with the marketplace's own terms of service, seller policies, and applicable laws.
  • GoBower acts as a tool to facilitate publishing; we are not a party to any transactions between you and marketplace buyers.
  • We may access your marketplace data (shop information, listings) solely to provide the integration features you have authorized.
  • You may disconnect your marketplace account at any time from your account Settings.
  • We do not guarantee the availability or continued operation of any third-party marketplace integration.

The term "Etsy" is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.

6. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, defamatory, obscene, hateful, or violates third-party rights.
  • Infringe copyrights, trademarks, or other intellectual property rights.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Attempt to circumvent usage limits, reverse-engineer the AI models, or scrape the Service.
  • Transmit malware, spam, or other harmful code.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Generate CSAM or any content that sexualizes minors. This is an absolute prohibition.

We may remove content and suspend or terminate accounts that violate these rules at our sole discretion, without refund.

7. Termination

Either party may terminate this agreement at any time. You may close your account from Settings → Account. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice. Upon termination, your right to access the Service ceases, and we may delete your data subject to our retention obligations.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL MEET YOUR EXPECTATIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBOWER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

10. Indemnification

You agree to indemnify, defend, and hold harmless GoBower and its affiliates from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from: (a) Your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your infringement of any third-party rights.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

For disputes under $10,000, either party may elect binding arbitration under the AAA Consumer Arbitration Rules. Class action and class arbitration are waived.

12. Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes at least 14 days in advance via email or an in-app notice. Your continued use after the effective date constitutes acceptance of the updated Terms.

13. Miscellaneous

  • Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and GoBower.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
  • No waiver: Our failure to enforce any right is not a waiver of that right.
  • Assignment: You may not assign these Terms without our written consent. We may assign them in connection with a merger or acquisition.
